Protecting your children in the event that something happens to you or your loved one is a critical step in the adoption process. Completing a will as early as possible can provide you and your family with peace of mind.

At Johnson Dorsey we can help you provide security for your loved ones in the event of an untimely death.It is critical that you have at least a simple Will. Having a valid Will prepared by a Texas attorney will allow you to have control over who gets your property, who will manage your affairs as executor, and who will serve as the Guardian of your minor children.

At the minimum you need the following documents :

  • A Will, which provides instructions for how your property should be distributed upon death.  This needs to be updated for changes such as the birth of a child.
  • A Power of Attorney, which allows you to appoint someone to handle your property and finances if you become unable to do so.
  • A Durable Healthcare Power of Attorney, which allows you to choose someone you trust to make medical choices on your behalf.  This document covers all health care decisions and lasts as long as you are incapable of making decisions for yourself.  You can also set out specific provisions in the POA instructing your agent how you would like them to act in regards to deathbed issues. This document is used for example if you want to refuse dialysis or blood transfusion.
  • A Living Will, is limited to your deathbed concerns only. It is used to declare your desire to not have life-prolonging measures taken if there is no hope of recovery. A living will generally covers very specific issues like “do not resuscitate.”
